On July 9, 2026, Governor Mike Kehoe signed law Mo. Statute Section 379.135 which significantly changes the law of Missouri regarding the ability for an insured or claimant to assign rights to a claim or covered loss to a third party.

The Missouri Appellate Court recently handed down an excellent decision upholding the assault and battery decision and rejected the attempt by the plaintiff to avoid the exclusion by contending that there were separate and non-excluded causes of the injury invoking the concurrent proximate cause doctrine in Missouri.
