John Cooney successfully obtained a defense win in favor of a local construction contractor following a week-long arbitration in the City of St. Louis. The construction dispute arose from the construction of the multi-million-dollar Community Ice Center in Maryland Heights, Missouri (the practice facility for the St. Louis Blues). The claimant alleged that Mr. Cooney’s contractor client caused damages in excess of $2.5 million due to a breach of contract and poor workmanship on the project. The case was heard over the course of a week by a panel of three experienced construction arbitrators. At the conclusion of the arbitration hearing, and following months of post-hearing briefing, the Panel found in favor of John’s client on all claims, awarded the claimant zero damages, and awarded John’s client in excess of $150,000 its attorney’s fees, costs, and arbitration expenses.
