After extensive discovery in a construction defect lawsuit the Camden County Circuit Court granted Summary Judgment for the WWBH clients, a custom home contractor and its President, on Plaintiffs’ claims that defects in the construction of the home’s stucco exterior and windows led to water infiltration and that misrepresentations were made regarding the quality of the home. The homeowner was seeking $750,000 in damages for the failing stucco. The Court held that Plaintiffs’ claims were barred by Missouri’s Statute of Repose, RSMo. § 516.097, as Plaintiffs purchased the home more than ten (10) years prior to filing their action. WWBH Principal Brendon Sanders, along with Associate Samuel Rebmann, convinced the Court that there were no exceptions to the statue and the time for filing had expired and the court incorporated much of Brendon’s briefing into its written ruling granting our Motion for Summary Judgment.
