The US District Court, Western District of Missouri Southwestern Division recently entered judgement on behalf of the WWBH client Auto Owners-Insurance in a unique coverage dispute, wherein the spouse of the severely injured insured claimed her loss of consortium claim entitled her to a separate policy limit, in addition to the policy limits that were paid to the injured spouse. Russ Watters and Lucas Ude secured summary judgement in their client’s favor confirming that the UIM section of the Auto-Owners Missouri auto policy was not ambiguous and afforded no additional coverage to the insured asserting a loss of consortium claim.
