Judgment for Business Owner and Store Manager Finding Not Liable for Slip and Fall

The U.S. District Court for the Eastern District of Missouri granted summary judgment for WWBH clients, a gas station and its store manager, in a premises liability action where the Plaintiff claimed injury to her right knee and economic damages exceeding $200,000. The Eastern District concluded that the gas station and its store manager were not liable for the injury the Plaintiff sustained after she slipped and fell on an oil spot on the parking lot of the gas station’s premises. To reach that conclusion, the Eastern District held that Plaintiff could not establish the store manager knew of or caused the oil spot. The Eastern District similarly concluded that there was insufficient evidence demonstrating the gas station knew, or should have known, of the oil spot or failed to use ordinary care to remove or warn of the substance prior to the Plaintiff’s fall. WWBH Principals Jackie Kinder and Patrick Meyer represented the gas station and its store manager. Click below to read the memorandum and order in its entirety.
