Principal Alexa Lester, with assistance from Benjamin Niemeyer, brought in a victory for their WWBH insurance carrier client in a first party property insurance lawsuit. The Plaintiffs were homeowners and named insureds on a homeowners’ policy. Plaintiffs alleged that the insurance carrier refused to pay their $70,000 claim for interior water damage and exterior damages, which they claimed were caused by a wind and/or hail event. Alexa argued that the client paid all amounts due and owing under the insurance policy, that the loss was not sudden and accidental loss, and the claimed damages were caused by multiple exclusions in the insurance policy, including deterioration and faulty workmanship. In addition, a substantial area of the exterior of the home had no physical damage, but rather Plaintiffs were only seeking replacement for matching purposes. After several days of trial, a St. Charles County jury found in favor of the WWBH client and entered a full defense verdict.
