In 2021, David Bub obtained summary judgment in the Circuit Court of Phelps County Missouri in a personal injury case where the plaintiff accidentally shot himself with an antique gun provided to him by David’s client. Plaintiff’s injuries were severe requiring numerous surgeries and medical bills in excess of $350,000. The claims against the defendant focused on defendant’s lack of warnings and information/training given to plaintiff of this unique antique firearm. After lengthy briefing and argument, the trial court granted defendant’s motion for summary judgment holding that defendant had no duty to warn and/or provide training to the plaintiff.
