Re-Trial of Case Results in Verdict 15 Times Lower Than Original Plaintiff Verdict

In 2022, David Bub and his partner, Tyler Finnegan, successfully defended an individual in a clear liability auto case in a re-trial of the case. In the first trial, handled by prior defense counsel, plaintiff claimed she became disabled due to a severe rib injury caused by the accident. Plaintiff claimed as a result of the injury, she was required to close her professional photography business. Prior defense counsel offered $100,000 to settle the case prior to trial. Plaintiff obtained a verdict of $1.5 million against defendant. David was retained after the first trial to appeal the case. After a successful appeal, a new trial was ordered. After a five-day jury trial on the same set of facts, the jury awarded plaintiff $80,000 (after assessment of comparative fault) which was 15 times less than the original verdict.
