Principals Bob Brady and Alexa Lester recently obtained a defense verdict in St. Louis County involving a first-party fire loss claim. Plaintiff argued the WWBH client breached the insurance policy contract when it refused to pay plaintiff’s fire loss claim. Plaintiff took the position that his actions caused the fire but claimed he did not intentionally set the fire. The WWBH client denied the claim and argued plaintiff intentionally set the fire. At trial, plaintiff maintained his position that although his actions resulted in the fire, the cause of the fire was an accident. Plaintiff asked the jury for more than $130,000 in dwelling and personal property damage. After a two-day jury trial, a St. Louis County jury came back with a unanimous defense verdict in favor of the WWBH client.
